No, I don't think that you were wrong. First off, he shouldn't even be on his cell phone, because that is a major distraction to his driving and could potentially put you at risk by riding with him. Secondly, you do deserve a nice and peaceful cab ride. Since you paid for the ride, and it is clearly stated in the rules, I don't see any reason that you were wrong in asking him to get off of his cell phone. He can save his 'talk' time for when he doesn't have cab riders.
